Haze Guitars & Radio Nova Custom Guitar Competition 2011 Terms & Conditions

The prize is a custom solid-body electric guitar or bass, up to a final retail value of €2500, made to your specifications by Haze Guitars. Assessment of final retail value, and of the practicality of all specifications will be made by a representative of Haze Guitars. In the event that desired specifications are not considered practically viable, or are considered to exceed the assessed final value, alternative specifications will be provided at the discretion of Haze Guitars.

No cash alternative will be offered for prizes.

As the prize is a completely custom instrument, delivery will be dependent on specification but is estimated to take no longer than 20 weeks after the completion of the specification process. Haze Guitars reserves the right to alter this estimate based on the availability of 3rd-party parts or materials required for the instrument’s completion.

Upon completion, the instrument must be collected within 30 days. If it is not collected within this time, the prize will be forfeit.

It is the responsibility of the prize winner to secure the necessary travel arrangements to meet with Haze Guitars for both the instrument specification process and to collect the completed instrument. Haze Guitars will not be responsible for any expenses incurred by the winner in the process of specifying or collecting his/her prize.

Competition is open to residents of the Republic of Ireland only.

These terms and conditions are in addition to any specified by Radio Nova.

The completed instrument carries a five year, non-transferable, limited warranty (see Warranty Terms and Conditions below)

Warranty Terms and Conditions
Haze Guitars warrants, solely to the original owner, that the instrument shall be free from defects in materials and workmanship under normal use for a period of five years or until ownership of the instrument is transferred to another. This Limited Warranty does not apply: (i) to asserted defects caused by modification, misuse or abuse or by improper maintenance of the instrument; (ii) to wear or breakage of frets or strings, or to other normal wear and tear of the instrument or its parts; (iii) to asserted defects involving subjective personal likes or judgements, (iv) to asserted defects caused by accident or exposure to extremes of temperature or humidity which cause harm to the instrument; (v) to the subjective issue of tonal characteristics; (vi) to cracking, discolouration or damage of any sort to the finish or plating for any reason.

Limitation on Obligations
The obligations of Haze Guitars are limited to repair or replacement of the parts of the instrument found to be defective under this Limited Warranty. In no event shall Haze Guitars, nor any of its representatives, be liable for any indirect, incidental or consequential damages, including but not limited to time, wages or lost profits, of any nature or kind or for damages to or loss of property. This Limited Warranty is the sole warranty of Haze Guitars with regard to Haze Guitars instruments and is given in lieu of all other warranties, express or implied, including any implied warranties of merchantability and fitness for purpose.

No Other Warranties
This Limited Warranty set forth herein constitutes the entire warranty and representation of Haze Guitars with regard to its instruments. This Limited Warranty shall be controlling over any conflicting terms and conditions or any purchase orders, contracts or invoices that may be executed in connection with the purchase or prize-winning of any Haze Guitars musical instrument. No representation or warranty made by any Haze Guitars salesperson, dealer, agent, representative or employee shall be binding upon Haze Guitars other than as set forth within.

Claim Procedures
Claims for warranty performance and service shall be made by sending the instrument to Haze Guitars, shipping and insurance prepaid by the instrument’s owner, at the address provided on presentation of the instrument. In the event it is determined that the asserted defect is not covered by or is excluded from this Limited Warranty, the instrument shall be returned without repairs or replacement, shipping and insurance to be paid by the instrument’s owner.
